The Department of Justice yesterday filed suit against New York and its Governor, Attorney General, and Head of the DMV (all in their official capacities, not personally, which is an interesting wrinkle) for the NY Green Light Law.
Here is the actual lawsuit. It is 16 pages long and an easy read. You should read it. Go ahead, read it.
US v New York, et al
What is it all about, Big Red Car, I’m lazy?
The issues are very simple, dear reader:
1. New York, a sanctuary state and a liberal paradise, passed a law called the Green Light Law that:
a. allowed every illegal alien over the age of 16 to obtain a driver’s license;
b. directed the NY Department of Motor Vehicles not to cooperate with the Federal government on sharing drivers’ license data without a warrant (which requires a trip to a court and a hearing) for that individual driver’s data; and,
c. upon receiving such a warrant, the NY DMV is obligated to alert the driver as to the inquiry.
The obvious objective was to throw sand in the gears of the Feds in identifying, apprehending, and deporting illegal aliens. You think that illegal alien isn’t going to flee after notification?
2. The DOJ contends this violates the “supremacy clause” of the Constitution (Article VI, Clause 2) that holds that Federal laws trump State laws.
3. In addition, the DOJ contends this is obstruction of the pursuit of Federal law – a big no no.
4. The DOJ also contends this endangers Federal agents doing their work.
What is unsaid, but is also on the table is New York’s Motor Voter Law whereby if you obtain a driver’s license you can apply on line to vote. Boom!
You will not read that in the media, but that is also a huuuuuuge issue particularly with New York City now considering allowing illegals to vote in municipal elections anyway.
It is not a difficult case to understand or to which to apply legal logic. It is a two handed dunk shot with the DOJ on a ladder for goodness sake.
What’s really going on here, Big Red Car?
This is the first shot (they went after Illinois first for other issues) in the war on sanctuary states and cities.
The Trump 2.0 Department of Justice and the Attorney General are going to drive this legal skirmish to the Supreme Court and a final decision.
Whilst there is many a “slip betwixt the cup and the lip” this looks to be something that can be dealt with in short order.
Trump 2.0 will withhold Federal funding and tee it up in the courts at the same time.
Are the Dems and the Sanctuary Illuminati going to take this lying down, Big Red Car?
No, of course not.
The first thing to happen is that New York Governor Kathy Hochul has requested and been granted a seance with President Trump whilst she is in Washington for the Governor’s Association confab. She is going to try to plead her case. Good luck, Kathy.
One thing I admire about Trump is he is willing to meet with anyone and is unafraid to deal with his adversaries face-to-face. Some see it as a weakness, but I see it as a tremendous strength.
Bottom line it, Big Red Car
Simple bottom line today:
1. Trump 2.0 is unsheathing the dagger and going for the jugular on the legal nonsense of sanctuary states and cities. Less than a month in, and the Department of Justice has teed it up with both Illinois and New York.
We will shortly see how defiant all those mayors and governors will be in the face of the law. Put them all in jail, says your Big Red Car.
2. Trump 2.0 is going to deport every illegal alien who came in under the Biden regime.
One other thing is apparent from looking at the larger situation in New York State — the open border, the silly Motor Voter Laws, the press to convert illegal aliens into voters, that was always the Biden plan.
Trump 2.0 is going to undo all of that. Boom!
But, hey, what the Hell do I really know anyway? I’m just a Big Red Car.
